Partner Terms

1. Our relationship

• You are an independent service provider, not an employee, agent or partner in law of Jagdamba Associates.
• You decide when you are online, which sessions you accept and your own rates within the platform’s limits. Nothing is scheduled for you.
• TalkWith provides the platform, billing, payments and support. You are responsible for the services you give and for your own taxes.

2. Eligibility and verification

• You must be at least 18 years old and resident in India with a valid PAN and an Indian bank account or UPI ID.
• You apply as a listener, astrologer or coach. Coaches must hold any qualification or licence their field requires, and we may ask for proof.
• You must complete identity verification (KYC): your legal name, PAN, a government ID (Aadhaar, passport, voter ID or driving licence) and, if asked, address proof, plus payout details.
• We review every application, usually within two working days, and may approve or decline it at our discretion.
• Keep your details current. We may ask you to verify again at any time.

3. Your profile and rates

• Your profile, photos, videos, experience and specialities must be accurate and your own. Photos must show your face clearly and contain no nudity, contact details or third-party branding.
• You set a per-minute rate for chat, voice and video, and a price for paid messages, within these limits:

We may change these limits with notice in the app. A rate change applies to new sessions only.

4. Earnings and commission

Customers pay TalkWith; TalkWith keeps a platform commission and credits the rest to your earnings.

• These are the standard rates. Your applicable rate is always shown in the Partner app, and any change is notified in advance and applies only to future earnings.
• Sessions are billed exactly as described in the Terms of Use: calls in 10-second steps, chats per completed minute.
• Only astrologers can go live and receive gifts in live sessions.
• If a customer’s charge is refunded under our Refund Policy, your share of that charge is reversed.

5. Payouts and tax

• Clearing: each earning becomes available to withdraw 7 days after it is made. This covers refunds and payment disputes.
• Minimum withdrawal: ₹500, with one open request at a time. Your KYC must be verified.
• Schedule: withdrawal requests approved by Friday 6:00 pm IST are paid to your bank account or UPI ID on the following Monday (the next working day if Monday is a holiday).
• TDS: tax is deducted at source at 10% under Section 194J of the Income-tax Act, 1961 (or any rate the law later requires), shown before you confirm a withdrawal, deposited against your PAN and reflected in your Form 26AS.
• GST: if you are required to register for GST, you are responsible for it on your share.
• We may hold payouts while we investigate fraud, a serious complaint or a breach of these terms, and tell you why.

6. How you must work

• Follow the Community Guidelines in every session.
• Never ask for or share phone numbers, social media, payment details or addresses, and never take payment outside TalkWith.
• Do not record calls, video or live sessions, and do not share anything a customer tells you.
• Do not give medical, psychiatric, legal or financial advice you are not qualified and licensed to give. Never tell anyone to stop medical treatment.
• Do not promise guaranteed results, and never push costly remedies, products or services.
• If a customer appears to be in crisis, encourage them to call 112 or Tele-MANAS on 14416, and report the session.
• If a customer appears to be under 18, end the session and report it at once.
• Keep your availability accurate: go offline when you can’t take sessions.

7. Ratings and quality

Customers can rate and review sessions. We may take down reviews that break our guidelines, and we may limit the visibility of profiles with repeated complaints, missed requests or low ratings.

8. Suspension and termination

• You can stop being a partner at any time by going offline, or by deleting your account as described on our account deletion page. Withdraw your available earnings first.
• We may suspend or end your partner account for a breach of these terms, the guidelines or the law, failed verification, fraud or serious complaints. Earnings obtained through fraud or a serious breach may be withheld; other cleared earnings are paid out as usual.
• You can appeal a decision through our grievance process.

9. Your content

You own your profile photos, videos and text. You give Jagdamba Associates a non-exclusive, royalty-free licence to display them in the apps, on shared profile links and in promotion of TalkWith while you are a partner. You confirm you have the rights to everything you upload.

10. Confidentiality and data

Customer information you see is confidential. Use it only to provide the session and never copy, store or share it outside TalkWith. How we handle your own data, including KYC documents, is set out in our Privacy Policy.

11. Responsibility and indemnity

You are responsible for the services you provide. You agree to indemnify Jagdamba Associates against claims arising from your sessions, your content or your breach of these terms. The limitation of liability, governing law (Vadodara, Gujarat courts) and other general terms in our Terms of Use apply.

12. Partner support

For help with your application, earnings or payouts, use Settings → Help and support in the Partner app or write to partners@talkwithapp.com. We may update these Partner Terms; material changes are notified in the Partner app before they apply.
